The Role of the Independent Legal Advisor

Mediators are neutral and impartial professionals who cannot offer legal advice even where they have legal training. Each party in mediation should have their own independent lawyer to help them:

  • Learn how the law affects them
  • Evaluate the choices they will be making in mediation
  • Organize and present the detailed financial disclosure that is required in all family law matters (whether mediated or litigated)
  • Review the Mediation Summary and if appropriate, incorporate it into the Separation Agreement or Minutes of Settlement.
